L'Atelier du Figuriniste will honor your order, pre-order in accordance with these general conditions of sale which are valid at the time you place the order.
These conditions apply to the exclusion of all other conditions, in particular those in force for purchases from the L'Atelier du Figuriniste site (or any other digital platform) and those applicable in the case of purchases directly in store.
Article 1 – Definitions
General Conditions: these general conditions govern the relations between L'Atelier du Figuriniste and its Client. They must first be read and accepted in their entirety by the Customer, without any reservation or conditions, so that the Customer, duly informed, can register their Order or Pre-Order. No Order or Pre-Order can be technically registered on the website www.eroticfigurines.fr without the Customer having previously expressly confirmed having read and accepted the General Conditions.
L'Atelier du Figuriniste whose head office is 20 rue du grisard 69800 Saint Priest, registered 395 365 885 with the RCS of Lyon.
L'Atelier du Figuriniste is the commercial name of the company STEPHANE LACROUX.
The site www.atelierfiguriniste.fr is the exclusive property of STEPHANE LACROUX.
Customer: any consumer customer who is an adult natural person acting for purposes not falling within the scope of his commercial, industrial, artisanal, liberal or agricultural activity. L'Atelier du Figuriniste is an artisan retailer and is not intended to sell the products offered in large quantities. Consequently, L'Atelier du Figuriniste reserves the right to refuse orders for the same product in large quantities from 3 identical items.
Order: purchase made directly by the Customer in store, on the website www.atelierfiguriniste.fr, via its Facebook page or any other digital medium, relating to a Product available in Stock, with immediate and full payment of the Price.
Pre-order: special order made directly by the Customer in store, on the website www.eroticfigurines.fr, via the Facebook page (or any other digital medium) relating to Products currently being manufactured and not yet available in Stock by means of 'a firm reservation, with payment by the Customer of the entire price or a non-refundable deposit to L'Atelier du Figuriniste ("Deposit"), corresponding to 30% (Thirty percent) of the Price if this possibility is given to him during the sale.
Pre-Order opening date: date from which the Customer has the right to register a Pre-Order for a Product currently being manufactured and not yet available in Stock.
Days: every day of the week, except Saturday, Sunday and public holidays (Pentecost Day is also a public holiday).
Price: price set by L'Atelier du Figuriniste for the Products, appearing in store, on the website www.eroticfigurines.fr, on its Facebook page (or any other digital medium) at the time of conclusion of the purchase/sale contract, and must be paid in full by the Customer for the acquisition of the Product. The price is set in euros, all taxes included, excluding delivery costs or miscellaneous costs (such as, and without this list being exhaustive, bank charges, collection costs, exchange costs, customs costs, collection costs ).
Product: collector's statue, new or second-hand (Consignment), printed raw and painted, manufactured and produced according to a prototype, in a limited number of copies or not, sold with its certificate of authenticity or not, available only within the limit of Stock, and intended for an audience of people over 18 (eighteen) years old. The Product is not a toy, but a collectible figurine. L'Atelier du Figuriniste reserves the right to sell the Products directly to its Customers in store, on its website, its Facebook page or any other digital medium.
L'Atelier du Figuriniste presents in store, on its website, its Facebook page figurines and derived products with the necessary characteristics which allow them to comply with Article L 111-1 of the Consumer Code, which provides the possibility for the potential customer to know before taking the final order the essential characteristics of the products he wishes to purchase.
Any additional information on the product can be requested by email. The offers presented by L'Atelier du Figuriniste are only valid within the limits of available stocks and the production possibility of L'Atelier du Figuriniste.
Prototype: stp model on the basis of which the Products are manufactured.
Stock: set of Products already manufactured available on the website www.atelierfiguriniste.fr, its Facebook page or in store. In the event of a stock shortage for a Product in question, the Order is canceled. In this case, any payment paid by the Customer is fully reimbursed by L'Atelier du Figuriniste. as quickly as possible, with the option for the Customer to replace the Product with another Product of their choice, and possible reimbursement of the difference if the chosen Product is less expensive, or payment by the Customer of the surplus if the chosen Product is more expensive.
Article 2 – Scope of application
The Products are available worldwide.
The General Conditions apply to all Customers, to the exclusion of all other general conditions, special conditions, and all other documents which may be issued by the Customers themselves.
The fact, for Customers, of registering an Order or a Pre-order in store, on the website www.eroticfigurines.fr, via the Facebook page or any other digital medium constitutes express, complete and irrevocable membership, without reservation or conditions, to the General Conditions.
L'Atelier du Figuriniste may agree with the Customer in writing certain specific special conditions derogating from the General Conditions (“Special Conditions”). The Special Conditions deviating from the General Conditions on certain points prevail, for these points, over the General Conditions.
The fact that L'Atelier du Figuriniste does not avail itself at a given time of any of the clauses of the General Conditions or the Special Conditions cannot be interpreted as a waiver by L'Atelier du Figuriniste of subsequently availing itself of these clauses.
L'Atelier du Figuriniste reserves the right to modify and update its General Conditions at any time, without prior notification.
Article 3 – Order – Pre-order – Conclusion of the purchase/sale contract – Termination
The Customer registers his Order or Pre-Order in store, on the website www.atelierfiguriniste.fr or his Facebook page (or any other digital medium) by following the instructions given there, and after having read the General Conditions of Sale , confirming its reading and acceptance.
The purchase/sale contract is validated and concluded between the Customer and L'Atelier du Figuriniste upon registration by the Customer of his Order or Pre-order in store or on the website or Facebook page (“Date of conclusion of the contract purchase/sale").
By clicking on the “Validate” button at the end of the order process, the customer declares to accept the order and all of the general conditions of sale.
We remind you that confirming your order implies your obligation to pay the price indicated. Payment for your purchases can be made using the payment methods accepted by L'Atelier du Figuriniste indicated in article 8 - Payment methods.
In the event of an Order: The Customer is expressly informed of the fact that placing the Order requires him to pay in full and immediately, by validating his Order on the website www.atelierfiguriniste.fr “with obligation to pay” - this precision being mentioned clearly and legibly on the website www.atelierfiguriniste.fr. Full payment of the Price linked to the Order and delivery costs is immediate. The Customer is informed that the Product(s) will only be shipped or returned to the store once the full Price has been collected.
In the event of a Pre-Order: The Customer is required to pay the full price when ordering the Product by L'Atelier du Figuriniste. The Product is only delivered or given to the Customer in store after full payment of the balance of the Product Price, delivery costs, miscellaneous costs (such as, and without this list being exhaustive, bank charges, shipping costs). collection, exchange fees, customs fees, recovery fees) and applicable taxes. The Customer will be notified of the availability of their order and must pay the remaining amount due within 10 days of said notification; Failing this, the order will be canceled and the legal deposit (30%) will be lost.

Transportation costs
L'Atelier du Figuriniste applies a strict and careful packaging policy so that the products are perfectly isolated from the risks associated with transport and that the Customer receives said products in perfect condition. In order to maintain the quality of its shipments, EROTIC FIGURINES has decided to apply the following price scale:
For mainland France
€10.00 including tax for any package whose weight is strictly less than 2kg
€20.00 including tax for any package whose weight is greater than or equal to 2kg and strictly less than 5kg
€30.00 including tax for any package whose weight is greater than or equal to 5kg and strictly less than 10kg
€50.00 including tax for any package whose weight is greater than or equal to 10kg within the maximum limit of 30kg
L'Atelier du Figuriniste is a very young company; for its start of activity on the internet, only deliveries to relay points are offered to the Customer, ensured by a single service provider: Mondial Relay.
Beyond a weight of 30kg, or a size greater than L+H+D >= 150 cm (Length + Height + Depth), a specific quotation for transport costs must be made to L'Atelier du Figuriniste. As our service provider Mondial Relay does not handle packages weighing more than 30kg, L'Atelier du Figuriniste will use another carrier.
Home deliveries at reasonable costs are currently being studied.
Delivery terms
The delivery time does not constitute an essential condition of the purchase/sale contract, neither for the Order nor for the Pre-order. This being said, L'Atelier du Figuriniste deploys the means at its disposal to deliver the Products within a reasonable time.
The Company undertakes to make all material and human efforts to have the Products delivered as quickly as possible. These may vary depending on the Customer's geographical area, the delivery method chosen or the Product ordered.
If the delivery deadline of 30 days after production of the product is exceeded, except in cases of force majeure, the Customer may request termination of the contract by registered letter with acknowledgment of receipt, after having instructed the Company, under the same terms, to make delivery within a reasonable additional time, and if the Company has not complied.
In this case, the Customer will be reimbursed within 14 days if a payment has already been made.
In the event that delivery is impossible, due to an error or omission on the address indicated by the Customer, the Company will contact the Customer as quickly as possible in order to obtain a new delivery address and any delivery costs. additional costs will be the responsibility of the Customer.
Furthermore, the Company cannot be held liable for reasons linked to exceeding delivery times:
during periods of high demand, such as end-of-year holiday periods,
for delays caused by reasons of force majeure, i.e. due to the occurrence of an unforeseeable, irresistible event beyond its control,
for facts attributable to the carrier responsible for delivery.
An order is valid for one and the same delivery address. The products are delivered to the address indicated by the consumer on the order form. In order to guarantee you optimal service, we thank you for providing us with an address to which your order can be delivered during business hours. You must provide L'Atelier du Figuriniste with a complete and exact shipping address (with Digicode, entry code, etc.)
When you order several products at the same time and they have different delivery times, the delivery time of the order is based on the furthest delivery time. L'Atelier du Figuriniste, however, reserves the right to split shipments. Participation in processing and shipping costs will only be charged for a single shipment.

No cash on delivery will be accepted for any reason.
L'Atelier du Figuriniste declines all responsibility for the extension of delivery times caused by the carrier, particularly in the event of loss of products, strike, pandemic (non-exhaustive list).
The Products subject to an Order are shipped by L'Atelier du Figuriniste to the Customer within two working days following the Date of conclusion of the purchase/sale contract if the products are in stock and full payment has been made.
For Products requiring a specific order from L'Atelier du Figuriniste from its supplier, within the limits of available stocks, these preparation times will be at increased by the supplier's delivery time.
The Products subject to a Pre-Order are shipped and delivered to the Customer following a delivery date which is specified on the website www.eroticfigurines.fr or via its Facebook page for purely indicative purposes, expressed in quarters, and estimated at approximately 3 (three) to 4 (four) quarters (or more) following the Pre-Order opening date. The Customer is informed of the effective delivery date by L'Atelier du Figuriniste

To facilitate the processing of complaints regarding the delivery of the package, a contact form is made available to the Customer from the package tracking page. The Customer is advised to report within 10 calendar days following the delivery of the package by the carrier. Furthermore, in the event of a lost package, the carrier may ask the customer to specify the contents of their package in order to facilitate research, the customer may refuse to respond if they wish.

The delivery times indicated are times generally observed and communicated by the carrier. No compensation can be granted by L'Atelier du Figuriniste in the event of late delivery.
Neither party will have failed in its contractual obligations, to the extent that their execution is delayed, hindered or prevented by a fortuitous event or force majeure. Will be considered as fortuitous event or force majeure any irresistible facts or circumstances, external to the parties, unforeseeable, inevitable, independent of the will of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts. The party affected by such circumstances will notify the other within ten business days of becoming aware of them. The two parties will then come together, within one month, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which execution of the contract will be continued. If the force majeure lasts for more than three months, these general conditions may be terminated by the injured party. Expressly, the following are considered as cases of force majeure or fortuitous events, in addition to those usually retained by the jurisprudence of French courts and tribunals: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning, shutdown of telecommunications networks or difficulties specific to telecommunications networks external to customers.
Delivery errors:
The consumer must make to L'Atelier du Figuriniste on the same day of delivery or at the latest the first working day following delivery, any claim of delivery error and/or non-conformity of the products in nature or quality in relation to the indications appearing on the order form. Any complaint made after this deadline will be rejected.

Any complaint not made in accordance with the rules defined above and within the time limits cannot be taken into account and will release L'Atelier du Figuriniste from any liability towards the customer.
In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to L'Atelier du Figuriniste as a whole and in its original, unopened packaging, to the following address:

The Product must be returned as a whole, in its original packaging, complete and unopened, in perfect resalable condition and not damaged in any way. Any product which has been damaged or whose original packaging has been damaged will not be refunded or exchanged and will be returned to the customer at their expense.
Claims in the event of damage
Any anomaly concerning delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of "handwritten reservations", accompanied by the customer's signature. The customer must at the same time confirm this anomaly by sending the carrier within two (2) working days following the delivery date by registered mail with acknowledgment of receipt setting out said complaints. To be accepted, any return must be reported in advance to L'Atelier du Figuriniste Shipping costs are the responsibility of the Customer unless the item was damaged during shipping.
Article 5 – Right of withdrawal
Under article L121-6 of the Consumer Code, only for purchases made on the site www.eroticfigurines.fr or the Facebook page, the Customer has a withdrawal period of 14 (fourteen) days from from the same day of receipt of the Product (1st day of the deadline) by the Customer or by the person who received said Product in the name and on behalf of the Customer. The right of withdrawal may be exercised by the Customer before the expiration of this period of 14 (fourteen) days. If this deadline expires on a Sunday or public holiday, it is extended until the first following working day. In the event of withdrawal, the product must be returned by registered mail with acknowledgment of receipt or dropped off in store. The Customer himself bears all charges and costs of returning the product to L'Atelier du Figuriniste.
This right of withdrawal is exercised without penalty, with the exception of return costs.

To exercise his right of withdrawal, the Customer notifies L'Atelier du Figuriniste of the Withdrawal Form or any other letter in which the Customer declares his unambiguous desire to withdraw. The Customer must ensure that they retain proof of the exercise of their right of withdrawal, which is why L'Atelier du Figuriniste suggests that they exercise their right of withdrawal by returning the Withdrawal Form duly completed and signed by registered mail with acknowledgment of receipt. has :

The Customer does not have to justify the reasons leading him to wish to exercise his right of withdrawal.
In the event of exercising the right of withdrawal, L'Atelier du Figuriniste will reimburse the sums paid (including delivery costs) at the latest within 14 days from the date on which L'Atelier du Figuriniste is informed of the Customer's decision to withdraw and using the same means of payment as that used for the order (unless expressly agreed by the Customer for reimbursement using another means of payment). The seller may defer reimbursement until the day of recovery of the goods.
It is however specified, in the event of total or partial payment by gift vouchers, that these cannot be reimbursed either in cash, by check, or by bank card. Reimbursement of purchases made by gift vouchers will be made exclusively in the form of gift vouchers for an amount identical to that paid in this form.
No cash on delivery will be accepted for any reason.
In the event of depreciation of the product resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the product, the customer may be held liable. The Product must be returned as a whole, in its original packaging, complete and unopened, in perfect resalable condition and not damaged in any way. Any product which has been damaged or whose original packaging has been damaged will not be refunded or exchanged and will be returned to the customer at their expense.
In the event of late reimbursement by L'Atelier du Figuriniste (after receipt of the Product), the amounts owed by L'Atelier du Figuriniste are automatically increased in accordance with the provisions of the Consumer Code.
Please note that any reservation or order made online (via a marketplace, the reperegeek.fr site, the Facebook page, Instagram or any other digital means) and paid at the store (or at an event outside the store) does not open right to the withdrawal period.
Article 5 – After-sales service
L'Atelier du Figuriniste invites the Customer to inform it within fourteen (14) days following unpacking of the Product of any defects, breakages or deterioration that the Customer may have noticed and from which the Product may have suffered, by sending an e-mail to the after-sales service. sale of L'Atelier du Figuriniste (contact@atelierfiguriniste.fr) photos and explanations with a view to a possible refund, exchange or sending of a replacement part within a reasonable time.
The customer can request the exchange of the product, if it is available in stock. In this case, reshipment will be at the customer's expense.
All reimbursements are made by bank transfer, to the payment card (CB/Visa/Mastercard, etc.). On request L'Atelier du Figuriniste can also register a credit on the Customer's online account, the credit will then be deducted from their next order.
Article 6 – Legal guarantee of conformity
The Customer is fully informed of the fact that the Prototype photographed and displayed on the website www.eroticfigurines.fr, is with a view to promoting the Product on said site, and to allow the Customer, thus informed, to proceed with his Orders and/or or Pre-orders. The Customer expressly accepts the fact that the Prototype thus photographed does not identify with the Product as such, and has no contractual value. The description of the Prototype, its characteristics and the photos representing it come as closely as possible to the Product, and serve an illustrative purpose. Pursuing a constant concern for perfection and improvement, L'Atelier du Figuriniste may be led to adapt certain features and characteristics of the Product, in its final version, in relation to the Prototype.
L'Atelier du Figuriniste does not respond to defects in the conformity of an existing Product upon delivery. The purchasing customer may notify L'Atelier du Figuriniste of any lack of conformity in writing (email or registered letter). These lack of conformity will then be taken into account by L'Atelier du Figuriniste. A defect in the Product appearing within 24 (twenty-four) months is presumed to exist on the day of delivery, unless proven otherwise. The period available to the purchasing Customer to act as a legal guarantee of conformity is 2 (two) years from delivery of the Product. The purchasing Customer cannot, however, claim a lack of conformity if he was aware of it or could not have been unaware of it.
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions hereof cannot deprive the customer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the item sold. . The customer is expressly informed that L'Atelier du Figuriniste is not the producer of the products presented on its e-commerce site or in store, within the meaning of law n°98-389 of May 19, 1998 and relating to the liability of the makes defective products. Consequently, in the event of damage caused to a person or property by a defect in the product, only the liability of the producer thereof can be sought by the customer, on the basis of the information appearing on the packaging of said product.
In the event of a lack of conformity, the purchasing Customer has the choice between repairing the Product by the manufacturer, or replacing the Product by the manufacturer. The manufacturer has the right, however, to refuse this choice if it involves a manifestly excessive cost, taking into account the value of the Product or the importance of the defect, and in particular also in the event of a shortage of stock of the Product concerned or of out of stock of any other similar Product. If repair or replacement both prove impossible, the Customer has the option of requesting total termination of the purchase/sale contract or restitution of part of the Price. The legal guarantee of conformity action does not deprive the Customer of exercising a guarantee action against hidden defects.
For goods purchased second-hand or reconditioned and beyond 6 months from the date of purchase of the product, it will be up to you to prove the existence of the lack of conformity alleged at the time of purchase.
To exercise this guarantee, the products must be returned to us in the condition in which you received them with all the elements (accessories, instructions, etc.), as well as a copy of the purchase invoice. Products returned by post must be in packaging allowing transport in good conditions. In this case, shipping costs remain the responsibility of the customer.
You can also implement the guarantee against hidden defects within two years from the discovery of the defect. It will then be up to you to prove in particular that the defect existed at the time of purchase, that it was hidden and that it renders the product unusable.
Article 7 – Guarantee against hidden defects
For the Customer to be able to implement the guarantee against hidden defects, the defect affecting the Product must predate the purchase/sale contract and render the Product unfit for the use for which it is intended.
The Customer cannot act as a guarantee for hidden defects if he was aware of the defect affecting the Product, it being specified that the apparent nature of the defect is assessed at the time of delivery, and that the quality/skill of the Customer is taken into account. consideration for determining his knowledge of the defect.
L'Atelier du Figuriniste does not guarantee hidden defects when there is defective use of the Product.
The period available to the Customer to act as a guarantee for hidden defects is 2 (two) years from the discovery of the defect. The Customer who acts as a guarantee against hidden defects has the choice between the resolution of the sale, that is to say the return of the Product that he had acquired and the reimbursement of the Price, or the reduction of the Price, i.e. that is to say, keep the Product and be reimbursed part of the Price.
Article 8 – Billing – Payment – Payment methods
The Customer is obliged to pay the full Price when registering any Order. If there is a Pre-order, the Customer is obliged to pay the Deposit (30%) upon ordering and the balance of the Price upon receipt of the product in stock by L'Atelier du Figuriniste as well as any delivery costs. VAT is applied in compliance with the law and regulations in force in France. The invoice(s) issued by L'Atelier du Figuriniste for the payment of the Price take into account, if there is a Pre-order, the Deposit which will have been paid. Payment of the Price and the Deposit is made by bank card (Carte Bleue, Visa card, Eurocard/Mastercard) or bank transfer. Payments are made in euros, subject to good collection. All taxes and fees (such as, and without this list being exhaustive, bank fees, collection fees, exchange fees, customs fees, recovery fees) remain the exclusive responsibility of the Customer. The Client has the obligation to pay the Price and the Fees without having the right to unilaterally proceed with any compensation, reduction, withholding or suspension, of any nature whatsoever and for any reason whatsoever. Billing and payment are made in EUROS only. Conversions into other currencies are given for information only and are not contractual. In the absence, on the due date, of a payment by bank card, and as a penalty clause, the defaulting purchaser will have to pay in addition to the sale price, a sum of a lump sum of 250.00 euros (Two one hundred and fifty euros). This penal clause will remain definitively acquired by L'Atelier du Figuriniste, without there being any need to justify any damage.
In the event of a computer error in the calculation of the total amount due by the customer, the amount due will be equal to the sum of the prices in effect for each item at the time of the order and displayed on the respective pages of each product ordered, deemed price known and accepted by the customer, shipping costs, less any promotions subject to their applicability.

Article 9 – Limitation of liability
If the treatment reserved by L'Atelier du Figuriniste for complaints and reservations made by the Customer does not meet the Customer's expectations, the possible liability of L'Atelier du Figuriniste, if it were to be incurred, would be strictly limited to the amount of the Price of the product, and could not be extended to the direct or indirect consequences of the use by the Customer or by any other person, natural or legal, of the Product.
The photographs reproduced on the site and illustrating the articles presented do not fall within the contractual scope. L'Atelier du Figuriniste cannot be held responsible if an error appears in one of these photographs.
L'Atelier du Figuriniste cannot be held responsible for non-performance of the contract in the event of force majeure, and in particular, in the event of a total or partial strike, flood, fire, etc. (non-exhaustive list).
L'Atelier du Figuriniste has, for all stages of access to the site, the ordering process, delivery, customer service or subsequent services, only an obligation of means. L'Atelier du Figuriniste cannot be held responsible for any inconveniences or damages inherent in the use of the internet network, in particular a breakdown of the service, an external intrusion or the presence of computer viruses in accordance with case law.
Article 10 – Confidentiality – Personal Data
L'Atelier du Figuriniste is not responsible for the data, information or documents transmitted or communicated to it, by any means whatsoever, by the Client. By the simple fact of having received them, L'Atelier du Figuriniste cannot be presumed to have accepted them. L'Atelier du Figuriniste processes the information communicated to it by the Customer in compliance with the principle of confidentiality.
All our shipments are made with the greatest discretion.
L'Atelier du Figuriniste undertakes not to communicate contact details to third parties, with the exception of third parties involved in the execution of the order (transporters, banking services).
In the exceptional case of non-payment or payment fraud, L'Atelier du Figuriniste reserves the right to communicate all necessary data to the police services or competent courts.
In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, relating to the protection of individuals with regard to the processing of personal data and the free movement of such data, the Customer may request access, modification or deletion of data concerning him by sending an email to contact@eroticfigurines.fr indicating his name, first name, email address and customer reference.
Article 11 – Intellectual Property
All texts, comments, works, illustrations, works and images reproduced or represented on the L'Atelier du Figuriniste site are strictly reserved under copyright as well as under intellectual property and for the entire world. As such and in accordance with the provisions of the intellectual property code, only use for private use subject to different or even more restrictive provisions of the intellectual property code is authorized. Any reproduction or total or partial representation of the L'Atelier du Figuriniste site or all or part of the elements found on the L'Atelier du Figuriniste site is strictly prohibited.
The company names, brands, brands, logos and distinctive signs reproduced on the L'Atelier du Figuriniste site are protected under trademark law. The reproduction or representation of all or part of one of the aforementioned signs is strictly prohibited and must be subject to prior written authorization from the owner of the brand.
Article 12 – Reservation of ownership
The Products delivered to the Customer are transferred to him with reservation of title. The transfer of ownership is subject to full payment of the full Price of the order by the Customer. In the event of total or partial non-performance of its obligations by the Customer – in particular in the event of non-full payment of the Price in compliance with only one of the agreed deadlines – the purchase/sale contract is automatically terminated and L'Atelier du Figuriniste has the right to claim the Product at the expense and risk of the purchasing Customer, all or previously paid deposits remaining with L'Atelier du Figuriniste, without prejudice to any damages that could be claimed as a result of the resolution.
L'Atelier du Figuriniste reminds the Customer that when he (or a third party designated by him) takes physical possession of the products ordered, the risks of loss or damage to the products are transferred to him
Article 13 – Notification – Election of domicile
All notifications, all opinions and all comments to be transmitted by the Customer to L'Atelier du Figuriniste and vice versa are only validly notified if they are sent, following the method of communication specified in the General Conditions:

Article 14 – Validity
The nullity or inapplicability of any provision of the General Conditions cannot result in the nullity or inapplicability of the other provisions of the General Conditions.
Article 15 – Applicable law
The General Conditions, any Special Conditions, as well as any contract concluded between L'Atelier du Figuriniste and the Customer are governed and interpreted in accordance with French law.
Article 16 – Dispute management – Negotiation – Consumer mediation – Jurisdiction clause
Any disputes that may arise regarding the validity, interpretation, execution, non-execution, interruption or termination of the General Conditions, any Special Conditions and any contract, document , amendment concluded between L'Atelier du Figuriniste and the Client will be negotiated between them to define the most appropriate amicable solution. Any Customer has the right (and not the obligation), in the event of a dispute with L'Atelier du Figuriniste, to contact the consumer mediator chosen by L'Atelier du Figuriniste and approved by the Commission for the evaluation and control of consumer mediation. The conditions for contacting the said consumer mediator are detailed on its own website. Thus, in particular, it is recalled that the Customer can only contact the consumer mediator if he has previously tried to resolve the dispute with L'Atelier du Figuriniste by means of a written complaint. The Customer has one (1) year after his written complaint to L'Atelier du Figuriniste to contact the consumer mediator. In accordance with Article 14.1 of Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, the Customer may go to the electronic link to the online dispute resolution platform in order to enter a consumer mediator at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&ing=FR:
If the solution proposed by the consumer mediator is not accepted by L'Atelier du Figuriniste and the Customer, the most diligent party has the right to submit the dispute to the competent courts. In this case, the disputes will be subject to the exclusive jurisdiction of the courts within the jurisdiction of the Court of Appeal of Lyon, notwithstanding the possible plurality of defendants, incidental requests for forced intervention or warranty appeal.
Failing to contact the consumer mediator, the Lyon District Court or High Court has jurisdiction.
